The French Ministry of Justice is bringing together European experts on 25 November to discuss the practices used by Member States to monitor probation orders and sanctions facing youth offenders.
The conference's aim is to review national approaches, professional practices and the specific nature of sanctions facing youth offenders. This will be an opportunity for European experts to attempt to define new perspectives for judicial cooperation in the area of enforcement of sentences.
While cooperation for the enforcement of sentences is an essential axe of European judicial cooperation, only a few Member States have ratified the one text currently applicable, the European Convention on the Supervision of Conditionally Sentenced or Conditionally Released Offenders of 30 November 1964.
Confronted with the rise of probation orders within the European Union, the application of the principle of mutual recognition is now becoming necessary to enable sentenced persons to serve probation in their home country, thereby favouring their social rehabilitation. This practice will also enable judicial authorities to ensure that orders are properly enforced and that the specific obligations are met. The Framework Decision laying down the arrangements for transferring the enforcement of rulings to a Member State was the subject of a political agreement concluded at the Justice and Home Affairs Committees (JHA) of 6 and 7 December 2007.
