The exchange of authentic instruments within the European Judicial Area

Mrs. Rachida Dati, Minister of Justice, is organising a conference on "The exchange of authentic instruments within the European Judicial Area" in partnership with the Conseil supérieur du Notariat (High Council for the Notarial Profession).
This meeting is aimed at improving the exchange of authentic instruments within the European judicial area in order to facilitate the day-to-day life of citizens and businesses.
Moreover, recognising the legal scope of these documents as such, and not only their enforceability, throughout the European Union, irrespective of the Member State with jurisdiction, may significantly simplify the legal relations of mobile citizens and businesses in Europe.
Given this objective, the French presidency supports the initiative of the Council of Notariats of the European Union, which consists in encouraging the European Commission to envisage introducing legislation to this effect.
An authentic instrument, drawn up by a public authority or its representative, establishes the consensual legal undertakings made by and between individuals or businesses with complete security. It is now necessary to encourage EU judicial cooperation in order to consider the exchange of such documents from a wider perspective than their integration to court decisions.
The drive to improve mutual recognition in this area may be the first step towards a European authentic instrument as recommended by the Lamassoure report on "citizens and application of EU law" and efficiently meets France's objective to contribute to creating a Europe that is closer to its citizens.
